AT&T Smart Limits for Wireless: Terms of Use

Cellular Service Agreement/Price Plan
To the extent you have signed up to receive wireless services from AT&T, these Terms are subject to the Terms of your Wireless Service Agreement and Terms of your Rate Plan, including, but not limited to, the alternative dispute resolution policy that you agreed to when you signed up for such service.

In the event of any conflict between these terms and your Wireless Service Agreement and Terms of your Rate Plan, your Wireless Service Agreement and Terms of your Rate Plan will govern with respect to the issue(s) in conflict.

Important Information About Use of the AT&T Smart Limits for WirelessSM Service / Web Site
Ability to access the Internet is a requirement to utilize the AT&T Smart Limits for Wireless service.

AT&T Smart Limits for Wireless, for a variety of reasons, may overcount or undercount your actual usage. As a result, you may incur overage charges despite having set Text/Instant Messaging Limits, Browsing Limits or Download Limits or you may be prevented from using some minutes, messages or data usage (KB/MBs) included in your plan. The principal causes of miscounting include:

  • Traveling outside the time zone you indicated as the primary place of use
  • Network communication delays or outages
  • Using the service on networks served by other carriers which do not support the AT&T Smart Limits for Wireless technology
  • Using the service while traveling internationally
  • Registering or changing settings in mid-billing cycle or changing rate plan in mid-billing cycle

AT&T Smart Limits for Wireless is not available on AT&T prepaid phones, corporate liable accounts or 4G LTE devices.

You are responsible for keeping the time zone setting for the phone user current and adjusting limits as necessary following any rate plan changes.

In some instances, AT&T Smart Limits for Wireless may not fully enforce Time of Day Restrictions.

AT&T Smart Limits for Wireless does not block any incoming calls except for calls from numbers you designated as Blocked Numbers.

AT&T Smart Limits for Wireless does not block premium charges that apply to premium text messages such as voting on the outcome of television shows and subscription services such as sports scores, horoscopes, and the like. Text/Instant Messaging Limits applies to Text and Instant Messages only and does not limit or restrict the use of picture/video messages.

AT&T Smart Limits for Wireless does not block or restrict Push to Talk service, outbound messages from AT&T Messages web site or tablet,Video Share, Visual Voicemail (VVM), and voicemail, BlackBerry email and BlackBerry Connect services. Browsing Limits and Time of Day Restrictions will not work for restricting data usage through non-MEdia™ Net Internet browsers. Certain data-centric devices such as smartphones and BlackBerry® devices offer non-MEdia™ Net browsers. In addition, Browsing Limits and Time of Day Restrictions will not block or restrict a user’s data usage if the user is also subscribed to DataConnect, LaptopConnect, tethering (connecting a wireless device to a laptop) or BlackBerry services, while the user is in Wi-Fi mode, or while using Apple® iPhone® software version 3.0 or later. Go to att.com/smartlimitscompatibility for more information on services not compatible with Smart Limits.

Unlimited services may be limited by the parameters you set in AT&T Smart Limits for Wireless. For example, unlimited messaging will be capped at the Text/Instant Messaging Limits you set. You can, however, change or remove the limits you set at any time.

There may be methods which allow Smart Limits for Wireless to be circumvented. If you are on a plan which includes domestic and/or international roaming charges, AT&T Smart Limits for Wireless does not block these charges. Limits and restrictions you set in AT&T Smart Limits for Wireless may not be enforced while roaming.

Allowed and Blocked Numbers work for enabling and blocking voice calls and text messages only and do not enable or prevent the use of instant messaging or picture/video messaging or Video Share. We recommend that you set your own phone numbers as Allowed Numbers so that you and your child can continue to call and text each other regardless of limits or restrictions you set in AT&T Smart Limits for Wireless. Calls and Text Messages to and from Allowed Numbers may result in overage charges. If the calling party number (Caller ID) on incoming calls is not available, AT&T Smart Limits for Wireless cannot recognize it as an Allowed or Blocked number. Therefore, there may be instances where an incoming call from an Allowed Number cannot reach your child when AT&T Smart Limits for Wireless restrictions are in effect or an incoming call from a Blocked Number is not blocked from reaching your child.

Media™ Net Parental Controls Content Filters do not block access to the Web through non-MEdia™ Net Internet browsers. Certain data-centric devices such as smartphones, iPhone, and BlackBerry® devices offer non-MEdia™ Net browsers. No filtering is 100% accurate and AT&T does not guarantee filtering accuracy. It is your responsibility to ensure that the AT&T Smart Limits for Wireless service is properly set up. You will continue to be charged the monthly fee for the AT&T Smart Limits for Wireless service whether or not you have set any of the AT&T Smart Limits for Wireless limits, restrictions, and/or other available features. AT&T reserves the right to terminate your AT&T Smart Limits for Wireless service with or without cause. Terms of Smart Limits for Wireless service are subject to change at any time.
